If your content is not suitable for sale on Amazon Kindle, please refrain from posting it on Pen Pinery.

1.4. No Guarantee of Outcomes: Users acknowledge and agree that Pen Pinery does not guarantee sales, reviews, exposure, or any specific outcome from use of the Website or ARC campaigns. Any metrics, signups, or activity shown on the platform are informational and do not constitute promises of results.

2.1. Account Creation: To access certain features of the Website, you may need to create an account. You are responsible for maintaining the confidentiality of your account information and are fully responsible for all activities that occur under your account.

2.2. Accuracy of Information: You agree to provide accurate, current, and complete information during the account creation process and to update such information to keep it accurate, current, and complete.

Users may not attempt to manipulate, purchase, or otherwise create reviews in a manner that violates platform rules or applicable laws. Pen Pinery will not be liable for reviews posted by users outside the platform.

4.1. License for Promotional Use: In order to help authors reach as many potential ARC readers as possible, you grant Pen Pinery a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, perform, adapt, modify (for formatting and technical purposes only), distribute, and communicate to the public your book-related content (including but not limited to book titles, pen names or author names, cover images, descriptions, taglines, blurbs, and review snippets) for the purposes of marketing, advertising, and promoting your books, ARC campaigns, and the Pen Pinery platform. 4.2. Social Media Channels: You acknowledge and agree that such promotional activities may occur on the Website and on third-party platforms, including but not limited to Reddit, Facebook, Instagram, TikTok, X (formerly Twitter), YouTube, and other online services now known or later developed, and that Pen Pinery has sole discretion to determine the timing, frequency, and format of such promotions. If you permanently remove specific content from the Website or close your account, Pen Pinery will not create new promotional materials using that content after a reasonable processing period; however, existing advertisements, posts, or campaigns that have already been produced or published may continue to run, be displayed, or remain accessible in the ordinary course of business. 5.2. Termination by User: You may discontinue your use of the Website at any time.

5.3. Effect of Termination: Upon termination, all licenses granted to Pen Pinery for your content remain as set forth in Sections 3 and 4 for material already used or distributed; no new use of removed content will occur.

No Warranty: The Website is provided 'as is' and 'as available,' with no warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Pen Pinery does not warrant any specific outcomes from the use of the Website, including author signups, reviews, or reader engagement.

Limitation: Pen Pinery shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising from your access to or use of, or inability to access or use, the Website. Users agree that Pen Pinery’s total liability, if any, shall not exceed the amount paid by the user for the services at issue in the prior twelve (12) months.

10.2. Refunds: All refund requests are handled directly through Stripe's platform. Pen Pinery does not process refunds or manage payment disputes. Users must contact Stripe to initiate and resolve refund requests.

10.3. Refunds and ARC Campaigns: If a user requests a refund after purchasing ARC credits and an ARC campaign has already been started, the campaign will be deleted immediately, and no refund will be issued for the credits used. If a refund is requested and no ARC campaign has been started (i.e., no ARC credits have been used), the refunded amount will be deducted from the user's ARC credit balance. Pen Pinery is not liable for lost data due to deleted ARC campaigns resulting from refunds or other payment processing reasons.

10.4. Stripe's Role: Pen Pinery is not responsible for payment processing errors, disputes, or delays caused by Stripe. Any issues related to payments or refunds must be resolved through Stripe's customer support.

10.5. No Retroactive Refunds: Refunds will not be issued for payments made prior to changes in pricing, promotions, or subscription terms. Users are responsible for reviewing the terms at the time of purchase.

10.6. Chargebacks and Fraudulent Claims: If a user initiates a chargeback or files a fraudulent claim for a payment made on Pen Pinery, their account may be suspended or terminated at Pen Pinery's sole discretion. Any ARC campaigns associated with the account will be deleted, and ARC credits will be forfeited.

10.7. Non-Transferability of Credits: ARC credits purchased on Pen Pinery are non-transferable and cannot be resold, exchanged, or transferred to another user. Refunds are applicable only to the original purchaser's account.

10.8. Currency and Taxes: All payments are processed in the currency displayed at checkout. Users are responsible for any applicable taxes, currency conversion fees, or additional charges imposed by their financial institution.
